Doctors Liability for Causing Drugged Patient's Accident
An elderly driver suffering various medical difficulties was being treated with several drugs. The drugs restricted his driving. After he achieved some improvement in his conditions his doctor cleared him to drive. He struck and killed someone while driving. The heirs of the person killed sued the doctor of the elderly driver contending he should not have allowed the man to drive. The Massachusetts Supreme Court considered wether the doctor could be sued.
